The Freedom of Information Act 2011 is one of the bills that took so much time in going through the legislative process. It spent over 11 years in the National Assembly before it was finally given presidential assent by President Goodluck Jonathan on the 28th of May 2011.
It is apposite to mention that the Freedom of Information Act 2011 is a right step in the right direction. It is in tandem with the provisions of section 39(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended). Section 39(1) of the 1999 constitution provides as follows:
‘’Every person shall be entitled to freedom of expression, including the freedom to hold opinions and to receive and impart ideas and information without interference.’’
In these notes, an analysis of the legal effect and implications of various provisions of the FOI Act 2011 is undertaken. There is also an exposition of how to make a freedom of information (FOI) request. So, have you been wondering how to make an (FOI) request, and about understanding the mechanism behind the Freedom of Information Act?
